Any training mandated by Federal OSHA will also be necessary for those employees who fall under the State program since West Virginia's State OSHA law approved Federal OSHA Regulations for State government industrial operations.

 

OSHA recommends its OSHA 10 Hour courses for entry-level workers and its OSHA 30 Hour courses for employees with supervisory roles because Federal OSHA requires training on specific health and safety topics, and the majority of employers in West Virginia demand Outreach training to ensure workers have an adequate awareness of Occupational Safety and Health.

 

Also, according to WV Law 21-3-22, employees engaged in construction projects that cost more than $500,000 must receive their OSHA 10 Hour Construction Certification within 21 days of their appointment. These projects include building, reconstructing, remodeling, and repairing.

 

On the other hand, many employees in the private sector are covered by Federal OSHA Jurisdiction; therefore, the U.S. Department of Labor regulatory body conducts routine inspections, issues tickets, and other activities.

 

The West Virginia Division of Labor is in charge of overseeing employees in the public sector, though. Moreover, employees of the West Virginia Legislature, the Department of Health, and the Department of Prisons are specifically exempt from the purview of State OSHA.
